driveEDR App Privacy Policy

The primary function of the driveEDR app, and the portable data acquisition device which plugs into the vehicle’s 12 V DC outlet (“the Service”) is to automate the capture of trips and exception events which are completed in a user’s vehicle. In order to automate this process, the Service requires permission from the User (and the owner/leasee of the vehicle if different from the User), to access accurate GPS and kinematic data  (even when the driveEDR app is not active in the phone screen). Users are prompted to grant this permission to the driveEDR app during setup, and before any trips can be captured.

The data captured by the Service during vehicle trips, is required for the purpose of recording the trip time, route, distance travelled and related driving events. This information is securely encrypted both while being uploaded and when stored on our servers. The data processing performed while on our servers relates solely to the pre-agreed purpose, which includes, but not limited to, capturing these metrics:

  • driver identity (full name and email address)
  • phone type, phone number, operating system version and unique identifier of the mobile phone
  • vehicle ID (VIN)
  • vehicle geolocation, with related dates and times,
  • driver behavior exception events (including speeding, heavy acceleration, harsh cornering and hard braking)
  • crash events (including location, date, time, severity and type of event)

These data are used for the purpose of providing auto insurance, measuring vehicle usage, characterizing and quantifying vehicle collision events, preparing tax returns or for vehicle usage reimbursement.  Other than the parameters listed above, no data captured using the Service is shared with any 3rd parties without the permission of user and the owner or leasee of the vehicle.

Persons using the Service are subject to this Privacy Policy. Prior to using the Service, and or submitting any personal information to us, you accept and agree to the practices described in this Privacy Policy document, and to the processing of your data in the United States or within the European Union. driveEDR employees and contractors who may have access to your data in order to provide the Service, are required to maintain the privacy and confidentiality of your information and follow this Privacy Policy.  If you do not agree to the terms of this Privacy Policy, do not use this Service. This Privacy Policy may change from time to time, and your continued use of the Service after such changes will be deemed as acceptance of these changes. All users can review data relating to their trips captured via the app by logging into a portal via www.driveEDR.com using provided credentials.

Notwithstanding the above, we may divulge information about you (i) if we are required to do so by legal authorities, regulation or legal process, such as a court order; (ii) in response to official request by government agencies; or (iii) when we believe disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss; or (iv) in connection with an investigation of suspected or actual unlawful activity. If you do not accept the release of your information in these situations, do not use the Service.
